Supreme Court Sets October 22 for Kolubah’s Appeal Against Expulsion

MONROVIA, LIBERIA — The Supreme Court of Liberia will hear Representative Yekeh Y. Kolubah’s appeal against his expulsion from the House of Representatives on October 22, setting the stage for a critical legal battle over his removal from the legislature.

The proceedings are scheduled for 11 a.m. before the full Bench of the Supreme Court.

Kolubah’s appeal follows a May 2026 decision by Chamber Justice Yussif D. Kaba, who dismissed his Bill of Information on procedural grounds.

Justice Kaba ruled that the House of Representatives had not been properly served with the writ of prohibition and stay order, as required under the legislature’s internal rules.

According to court records, the documents were delivered to a receptionist and a computer operator in the offices of the Speaker and the Chief Clerk instead of the Sergeant-at-Arms, who is authorized to receive court documents on behalf of the House under House Rule 26.5.

The Chamber Justice determined that the delivery did not constitute valid service, rendering the contempt proceedings legally defective.

He further emphasized that a party cannot be held in contempt without proof that it had actual or constructive notice of the relevant court order. Consequently, he concluded that the House could not be held liable for contempt because the writ and stay order had not been lawfully served.

The full Bench will now review the appeal and consider the legal issues arising from the Chamber Justice’s ruling.

The outcome could shape the next stage of Kolubah’s legal challenge to his expulsion from the House of Representatives.
